版权及资源使用声明

一、平台定位与核心原则

本平台是面向软件与游戏爱好者的非商业性技术交流与研究平台，聚焦技术学习、产品测评、游戏运行环境优化及 MOD 视觉增强技术研究，仅对互联网公开可获取的共享资源进行合理整理与呈现，或展示用户基于学术交流目的自行上传的内容。平台旨在推动行业技术交流与经验分享，不涉及任何资源的原创开发、非法破解或商业性牟利活动，严格遵守《中华人民共和国著作权法》（2020 年修订）、《计算机软件保护条例》（2002 年施行，2013 年、2017 年修订）等相关法律法规，始终尊重并保护原著作权人的合法权益。

二、资源来源与知识产权说明

  1. 平台展示的软件、游戏测试试玩版本、模组（MOD）、皮肤素材及相关技术文档等资源，均来源于互联网公开渠道，或由用户基于学术交流目的自行上传，平台仅进行合理整理与呈现，不参与资源的原创开发或非法获取。
  2. 平台所引用的游戏名称、商标、美术素材、软件代码等相关知识产权，均归属于其原始权利人或合法授权方，平台仅为技术交流目的进行合理使用，不主张对该类知识产权的所有权。

三、资源使用规范（“24 小时” 使用准则）

  1. 使用范围限制：用户获取的所有平台资源，仅限用于个人本地端的技术学习、研究软件设计思想与技术原理（如分析代码结构、验证功能逻辑等）、美术设计参考等合法非商业用途，严禁用于商业盈利（包括但不限于盈利性传播、销售、嵌入商业产品、广告分成等）或非法用途（如破坏他人系统、侵犯隐私、规避正版授权等）。
  2. 强制删除义务：根据相关合规惯例及法律规定，用户下载或获取资源后，须在 24 小时内从所有个人设备（包括电脑、移动终端、存储介质等）中彻底删除，不得留存、备份或二次传播（包括分享至社交平台、论坛、网盘等）。
  3. 正版支持倡导：若用户对资源功能认可并希望长期使用，应主动支持正版，通过原著作权人或其授权的正规平台购买注册，获取合法授权及官方技术支持、更新维护等服务，共同维护健康的知识产权生态。

四、内容分级与品牌安全保障

  1. 年龄准入限制：鉴于部分研究内容涉及 PEGI 18/ESRB M 级别作品，平台已建立严格的准入确认机制，用户需确认已满 18 周岁后方可访问相关技术研究区域。

五、法律依据

  1. 根据《计算机软件保护条例》第十七条规定：“为了学习和研究软件内含的设计思想和原理，通过安装、显示、传输或者存储软件等方式使用软件的，可以不经软件著作权人许可，不向其支付报酬。” 用户仅可在该条款界定的 “合理使用” 范围内使用平台资源，超出范围的使用行为需自行取得原著作权人许可。
  2. 根据《中华人民共和国著作权法》第二十四条规定，“为个人学习、研究或者欣赏，使用他人已经发表的作品” 属于合理使用，但不得侵犯著作权人依法享有的署名权、修改权、保护作品完整权等其他合法权利。

六、侵权投诉与快速处理机制

  1. 投诉材料要求：若任何单位或个人（以下简称 “权利人”）认为平台展示的内容侵犯其合法权益（如著作权、邻接权等），需提供书面投诉材料（可扫描或电子版），内容包括：权利人身份证明（个人提供身份证复印件，企业提供营业执照复印件及授权委托书）、侵权内容在平台的具体链接、侵权事实说明（明确侵犯的权利类型）、合法权属证明（如版权登记证书、授权合同等）。

  3. 处理流程承诺：平台建立快速响应机制，在收到合法且完整的投诉材料后，将在 48 小时内核实并执行资源下架或断开链接操作；经核实确属侵权的，可根据权利人要求提供侵权用户的非隐私性信息（如注册 IP、操作记录等），配合维权工作。
  4. 虚假投诉责任：若权利人虚假投诉或滥用投诉权利，导致平台或第三方遭受损失（如名誉损害、经济赔偿等），平台保留追究其法律责任的权利。

七、用户责任与免责声明

  1. 用户责任：用户若违反本声明约定，将资源用于商业 / 非法用途、逾期未删除或二次传播，由此产生的一切法律责任（包括但不限于著作权侵权赔偿、行政罚款、刑事责任等）及经济损失（如原权利人索赔、司法诉讼费用等），均由用户自行承担，与平台无涉。
  2. 平台免责：（1）平台不担保资源的绝对安全性（如是否含病毒、恶意代码等）与完整性（如是否存在功能缺陷、文件损坏等），用户下载使用前应自行进行安全检测，因使用资源导致设备损坏、数据丢失等不良后果，平台不承担赔偿责任或连带责任。（2）平台仅提供资源的展示与跳转下载服务，不对资源的原始来源、版权归属及合法性负责；若因资源本身的版权争议引发纠纷，除非证明平台存在故意包庇或重大过失（如收到投诉后拒不处理），否则平台不承担相关责任。

八、知识共享协议（针对平台原创整理内容）

平台对自行整理的技术文档、资源分类说明等原创内容，采用知识共享署名–非商业性使用–相同方式共享 4.0 国际许可协议（CC BY-NC-SA 4.0），具体要求如下：

  1. 他人转载或使用该类内容时，需在新作品的显著位置（如首页标题下方、文末声明处）注明原作者（本平台名称）、原始来源（平台具体链接）及本许可协议类型。
  2. 仅可用于非商业目的。任何第三方不得直接或间接通过此类内容获取利润（包括但不限于付费阅读、资源售卖、捆绑销售等）。本平台为抵消服务器带宽、网络边缘加速服务及相关技术研究的日常运行成本而收取的展示性广告收益（如 Google AdSense）除外。”
  3. 基于该类内容创作的衍生作品（如修改、节选、重组后的文档），需采用与本协议相同类型的许可协议，确保衍生作品的使用规则一致性。

九、附则

  1. 用户在点击 “提交”、“查看”、“访问资源” 或开始浏览平台内容时，即视为已完整阅读、理解并接受本声明的全部条款；若不同意任何条款，应立即停止使用平台服务。
  2. 平台有权根据法律法规更新或业务调整，对本声明内容进行修订，修订后的版本将在平台首页显著位置公示，公示之日起生效，用户应定期查阅以了解最新条款。
  3. 本声明的解释权归本平台所有，若条款内容与法律法规相冲突，以法律法规规定为准。

It strictly abides by relevant laws and regulations such as the Copyright Law of the People’s Republic of China (Revised in 2020) and the Regulations on the Protection of Computer Software (Implemented in 2002, Revised in 2013 and 2017), and always respects and protects the legitimate rights and interests of original copyright holders.

2. Resource Sources and Intellectual Property Statement

All resources displayed on the platform, including software, game trial versions, mods, skin materials, and related technical documents, are sourced from public channels on the Internet or uploaded by users for academic exchange purposes. The platform only performs reasonable collation and presentation, and does not participate in the original development or illegal acquisition of resources.

The intellectual property rights related to game names, trademarks, art materials, software codes, etc. cited on the platform are all owned by their original right holders or legally authorized parties. The platform only uses them reasonably for technical exchange purposes and does not claim ownership of such intellectual property rights.

3. Resource Usage Specifications (the “24-Hour” Usage Guideline)

Scope of Use Restriction

All platform resources obtained by users are limited to legitimate non-commercial uses such as personal local technical learning, research on software design ideas and technical principles (e.g., analyzing code structure, verifying functional logic), and art design reference. It is strictly prohibited to use them for commercial profit (including but not limited to profitable dissemination, sales, embedding in commercial products, advertising revenue sharing, etc.) or illegal purposes (e.g., damaging others’ systems, invading privacy, circumventing genuine authorization, etc.).

Mandatory Deletion Obligation

In accordance with relevant compliance practices and legal provisions, users must completely delete the downloaded or obtained resources from all personal devices (including computers, mobile terminals, storage media, etc.) within 24 hours, and are not allowed to retain, back up, or retransmit them (including sharing to social platforms, forums, network disks, etc.).

Advocacy for Genuine Support

If users recognize the resource functions and wish to use them for a long time, they should actively support genuine versions, purchase and register through original copyright holders or their authorized official platforms, obtain legal authorization, and enjoy official technical support, update and maintenance services, so as to jointly maintain a healthy intellectual property ecosystem.

4. Content Rating and Brand Safety Assurance

Age Access Restriction

In view of the fact that some research content involves works rated PEGI 18/ESRB M, the platform has established a strict access confirmation mechanism. Users must confirm that they are over 18 years old before accessing relevant technical research areas.

5. Legal Basis

According to Article 17 of the Regulations on the Protection of Computer Software: “For the purpose of learning and researching the design ideas and principles contained in the software, the use of the software by means of installation, display, transmission, or storage does not require the permission of the software copyright owner, nor shall remuneration be paid to him.” Users may only use platform resources within the scope of “fair use” defined by this clause. Any use beyond this scope shall require prior permission from the original copyright owner.

According to Article 24 of the Copyright Law of the People’s Republic of China, “the use of a published work by others for personal study, research, or appreciation” shall be deemed as fair use, provided that it does not infringe upon other legitimate rights and interests of the copyright owner, such as the right of authorship, the right of modification, and the right to protect the integrity of the work.

6. Infringement Complaint and Rapid Handling Mechanism

Requirements for Complaint Materials

If any entity or individual (hereinafter referred to as the “Right Holder”) believes that the content displayed on the platform infringes upon its legitimate rights and interests (such as copyright, neighboring rights, etc.), it shall provide written complaint materials (which can be scanned or electronic versions), including: identity certificate of the right holder (a copy of ID card for individuals, a copy of business license and power of attorney for enterprises), the specific link of the infringing content on the platform, a description of the infringing facts (clearly specifying the type of right infringed), and legitimate ownership certificate (such as copyright registration certificate, authorization contract, etc.).

Commitment to Handling Process

The platform has established a rapid response mechanism. Upon receipt of legitimate and complete complaint materials, it will verify and execute the resource removal or link disconnection within 48 hours. If the infringement is confirmed after verification, the platform may provide non-private information of the infringing user (such as registered IP, operation records, etc.) as required by the right holder to assist in rights protection.

Liability for False Complaints

If a right holder submits a false complaint or abuses the right to complain, resulting in losses to the platform or a third party (such as reputation damage, economic compensation, etc.), the platform reserves the right to pursue its legal liability.

7. User Liability and Disclaimer

User Liability

If a user violates the provisions of this statement by using resources for commercial/illegal purposes, failing to delete them within the time limit, or retransmitting them, all legal liabilities (including but not limited to copyright infringement compensation, administrative fines, criminal liabilities, etc.) and economic losses (such as claims by original right holders, judicial litigation costs, etc.) arising therefrom shall be borne solely by the user, and the platform shall not be held liable.

Platform Disclaimer

  1. The platform does not guarantee the absolute security (e.g., whether it contains viruses, malicious codes, etc.) and integrity (e.g., whether there are functional defects, file damage, etc.) of the resources. Users shall conduct their own security checks before downloading and using the resources. The platform shall not be liable for any adverse consequences such as device damage or data loss caused by the use of the resources.

  • When others reprint or use such content, they must indicate the original author (the platform name), the original source (the specific platform link), and the type of this license in a prominent position of the new work (e.g., below the homepage title, in the statement at the end of the article).
  • It may only be used for non-commercial purposes. No third party may directly or indirectly obtain profits through such content (including but not limited to paid reading, resource sales, bundled sales, etc.).
